Nevada Sexual Exploitation Charges & Digital Evidence

Nevada Revised Statutes 200.710 through 200.737 address several forms of alleged conduct involving minors. Nevada law now uses the term child sexual abuse material for visual material depicting the sexual abuse or exploitation of a child, although some searches and older sources use different terminology.

Potential allegations under these statutes include:

  • Production: Allegedly using a minor to create child sexual abuse material or a sexual portrayal.
  • Promotion: Allegedly directing, presenting, or promoting a minor’s sexual performance.
  • Preparation or distribution: Allegedly preparing, sharing, or distributing prohibited material.
  • Possession: Allegedly possessing or controlling prohibited files or images.
  • Internet-related conduct: Alleged activity involving certain controlled visual presentations or online communications.

Creating, promoting, distributing, accessing, and possessing material aren’t interchangeable legal allegations. The prosecution must prove the elements of the charged statute and connect the accused person to the alleged conduct.

Digital evidence may include device data, metadata, account records, messages, search history, cloud storage, and information supplied by online platforms. We examine what that evidence shows, who controlled the relevant device or account, and whether investigators followed constitutional search and seizure requirements.

What Can Affect Penalties in a Sexual Exploitation Case?

The potential consequences depend on the charged statute, alleged conduct, child’s age, accused person’s prior record, and whether state or federal prosecutors bring the case. Certain Nevada production and promotion offenses are category A felonies. First-offense preparation, distribution, and possession allegations can fall under category B felony provisions.

For certain category A offenses, Nevada law distinguishes between allegations involving a child younger than 14 and those involving a child who is 14 or older. Depending on the offense and final disposition, consequences can include imprisonment, fines, supervision, sex offender registration, immigration consequences, and restrictions affecting employment or housing.

Online transmissions, interstate activity, travel, and federal investigations can also raise jurisdictional questions. Federal charges proceed under laws and procedures that differ from those used in Nevada courts.
