If this person who has been arrested in this Dateline type sting is prosecuted at the State level for violating NRS 201.560, he will be given bail and receive probation with sex offender registration if convicted and may even be able to get his charges reduced to a non-sexual offense as I have done for clients of mine. However, if the federal government decides to prosecute him for violating 18 USC 2242(b), he will be facing a minimum 10 years of incarceration, lifetime registration as a sex offender after completing his minimum 10 year prison sentence if convicted! So it makes a huge difference if you are prosecuted at the state level or at the federal level.
