Basically every felony prosecuted at the federal level is a huge deal.  If you are facing federal charges, you must take them seriously or you will very likely be looking at a prison sentence.  Overwhelmingly, people charged with federal crimes receive prison sentences if convicted.  Federal crimes are prosecuted by the U.S. Department of Justice.  Unlike local law enforcement agencies such as the local police, the federal government has basically an unlimited budget to prosecute and has powerful agencies to investigate you in its corner such as the FBI, Homeland Security, and U.S. Customs to name a few.  Whether you will be charged with violating a federal offense or a state offense can depend on a number of factors.  For instance, some crimes such as identity theft are prosecuted at the state level because the amount of loss is low.  While the federal government could prosecute someone for using the internet to steal a few thousand dollars, the reality is the state would pick up such a prosecution.  But in larger investigations where there is a huge loss amount, the federal government and the U.S. Attorneys will often prosecute and subject the defendant to a much higher range of incarceration if convicted.  It makes a huge difference if you are prosecuted for a federal crime or a state crime.  Here’s an example – a man tries to meet whom he believes to be a minor through the internet as I’m sure you have seen on NBC’s Dateline: To Catch a Predator.  The man shows up and is arrested by police officers.  If this person who has been arrested in this Dateline type sting is prosecuted at the State level for violating NRS 201.560, he will be given bail and receive probation with sex offender registration if convicted and may even be able to get his charges reduced to a non-sexual offense as I have done for clients of mine.  However, if the federal government decides to prosecute him for violating 18 USC 2242(b), he will be facing a minimum 10 years of incarceration, lifetime registration as a sex offender after completing his minimum 10 year prison sentence if convicted!  So it makes a huge difference if you are prosecuted at the state level or at the federal level.
